Florida Courts currently lists Form 12.902(f)(3), dated October 2021, as a supporting document titled “Marital Settlement Agreement for Simplified Dissolution of Marriage.” Its instructions state that it is used after a Form 12.901(a) petition has been filed and the parties have reached agreement on all issues. Read those instructions instead of relying on this summary to decide whether the form applies.
Source freshness: the Florida Supreme Court has announced family-law form title changes effective October 1, 2026, and stated that the forms remain valid during the transition. Check the current forms index ↗ before starting. Read the official amendment opinion ↗
Read the fixed agreement language first
This is an agreement, not merely a worksheet. Much of its language is already written into the official PDF and is not changed by Sun State. Before entering information, both parties should read the complete document, including:
- The statements about disclosure, honesty, and completing documents needed to carry out the agreement
- The form’s treatment of personal items that are not listed in the asset schedules
- Section II’s fixed statement concerning spousal support or alimony
- The certification each party makes before signing
Sun State cannot interpret these statements, change them, determine whether they match the parties’ intentions, or recommend that either party accept them.
1. Case and marriage information
Have the basic information you intend to enter available:
- Judicial circuit and Florida county
- Case number and division, if assigned
- Petitioner’s and respondent’s full legal names
- Date of marriage
2. Assets assigned to each party
The official form contains one asset schedule for the petitioner and another for the respondent. Each schedule uses specific categories and asks for a clear description and current fair market value.
- The asset categories both parties independently decide to list
- A description that identifies each listed item
- Whether the name on a relevant title, deed, or account is one party’s name or both names
- The current fair market value the parties decide to enter
Sun State does not find assets, value property, decide who receives an item, or determine whether an entry fully describes the parties’ agreement.
3. Debts assigned to each party
The form also provides separate debt schedules for obligations to be paid by the petitioner and the respondent. For each debt the parties choose to list, the displayed fields may call for:
- The official debt category and a clear description
- The name or names shown on the mortgage, note, or account
- The current monthly payment
- The current amount owed
The software can total customer-entered schedule amounts, but it does not verify balances, classify a debt, or decide who should pay it.
4. Contingent items and other terms
The official document includes a blank for dividing contingent assets and liabilities identified in the parties’ financial affidavits. It also contains an “Other” section. Sun State transfers only the words the customer supplies and does not draft clauses, recommend terms, or determine whether additional documents are needed.
If the parties are unsure what to write, what an item means, or whether their intended agreement is adequately documented, they should consult a licensed Florida attorney rather than asking the software to create language.
5. Contact, signing, and notarization
The form has separate execution sections for the petitioner and respondent. The official instructions state that both parties sign and have their signatures witnessed by a notary public or deputy clerk. Sun State leaves dates, signatures, notarization areas, and nonlawyer-assistance sections blank.
- Each party’s printed name and contact information
- The complete agreement for both parties to review before signing
- The official instructions for signing, filing, service, and any electronic-service election
Complete the form the parties already selected
The official blank PDF is free. Sun State’s optional $39 self-service software transfers customer-supplied entries into its configured Form 12.902(f)(3), calculates entered schedule totals, and delivers editable, print, and unchanged blank PDFs. It does not review the agreement for fairness, completeness, enforceability, or legal sufficiency.
